Louisiana State Prison court decision could be predictor of Texas litigation

By Duane Stuart, Backgate Website

The Texas Prison Project along with the AFSCME filed litigation in federal court in Texas that if found valid could require all Texas prisons to be air conditioned in coming years. That case, which has not yet been heard in Texas, would cost taxpayers millions to comply with. Similar litigation in Louisiana regarding the same issues was heard in recent weeks and found to be valid by the court. Louisiana will now be required to ensure that all of their prisons are kept below 88 degrees at all times. That practice was initiated in recent years by the Texas Jail Commission regarding all Texas jails, but state prisons did not fall into the requirement. If past judgement reflects those of the future we can expect Texas will also be required to fall in line with the Louisiana decision.

  6. Not justifying abuse upon convicts from officers...but most outsiders don't ever see is the abuse upon officers from convicts. It goes both ways, Anonymous. I've responded to more than enough staff assaults caused by offenders simply because the inmate is mad that the officer is enforcing the rules. Not to mention the verbal abuse that convicts spew unceasingly. And all the masturbating and exposing of private parts. And --again, not justifying not providing medical care-- inmates do fake illnesses because they've gambled and can't pay, or they want to masturbate on a nurse, or for just getting away from his/her current situation. But, back on topic. Any state that provides comfort to convicts in any form --air conditioning in this case-- before providing it to its staff is a sad state, indeed. Texas, included. Yes, it will improve our working conditions. But, Texas should practice what it preaches in "doing the right thing" and 'taking care of family." The only language Texas understands is "lawsuit." Even the grievance procedure for staff and offenders is a joke. If anybody wants anything done, just sue.
