Investigation Pending After 63 Year Old Montford Unit Inmate Dies Following Force by Staff

Offender Wayne Benjamin McCoin, 63 (DOB 11-14-1950)
Serving a 99 Year Sentence Out of Red River County, Texas
for attempted capitol murder.  TDCJ # 923939.

Lubbock, Texas - The Texas Department of Criminal Justice Office of Inspector General is investigating the death of a 63 year old psychiatric inmate after he refused orders to be removed from his cell at the John Montford Prison Psychiatric Unit in Lubbock. 
 
Sometime during the daytime of March 19, 2014, correctional staff attempted to remove Benjamin McCoin, from his cell at the Montford Unit.  McCoin refused orders from correctional staff to be removed from his cell.  A 5 man extraction team was sent into the cell to remove McCoin, who was immediately examined by nursing staff and placed in another cell.
 
While in his newly assigned cell, McCoin complained to staff about a pain in  his hip and was taken to the University Medical Center in Lubbock  for observation.  That afternoon while at the hospital McCoin collapsed and immediate efforts by hospital staff to revive him failed.  McCoin was pronounced dead at 5:50 PM.

Violent Recidivism
 
McCoin was no stranger to the criminal justice system.  McCoin exhibited a history of violence and psychiatric episodes.  On October 22, 1985 McCoin committed an aggravated assault with a deadly weapon and was convicted of the crime in Lamar County on February 7, 1986, when he was sentenced to 2 years in the Texas Department of Corrections. 
 
Upon making parole from the Texas Department of Corrections, McCoin returned to Lamar County where on October 31, 1986 he committed his second aggravated assault with a deadly weapon.  This time McCoin was handed down a 10 year sentence on January 12, 1987. 
 
With a shortage of prison beds in the Texas Department of Corrections in the mid 80's and early 90's, making parole was easy, even for some of the most violent inmates.  Parole came early for McCoin who left the prison system and in 1992 became a  ranch hand in Red River County.
 
Life as a ranch hand gave McCoin access to the tools of the trade.  In East Texas beaver dams are a big problem.  The mud and stick compounds used by beavers can form a structure that can not be removed by hand implements and may be in marsh land that is not easily accessible for earth moving equipment.  McCoin, who was a violent convicted felon, was given access to dynamite to take down beaver dams on the property. 
 
McCoin was infatuated with his ex-wife Jeanette White.  McCoin allegedly became verbally abusive towards Jeanette and allegedly threatened her.  Jeanette reported the incident to Red River law enforcement.
 
On September 14, 1992, McCoin learned that Red River law enforcement were looking for him after a warrant was issued for his arrest.  Law enforcement officers went to the ranch looking for McCoin, but were unable to locate him that day. McCoin knew he would most likely return to prison for the third time, since he was still on parole for his second aggravated assault.
 
Revenge May Not be so Sweet in Texas
 
While hiding from the law, McCoin devised a plan to seek revenge for his ex-wife filing charges that would most likely mean his return to prison.  McCoin having learned how to use explosives to take out beaver dams, decided now to use the explosives to take out his ex-wife Jeanette White. 
 
McCoin keeping with his promise of revenge and violence against Jeanette, on the night of September 15, 1992 placed dynamite under the bedroom of Jeanette and her current husband Mitchell White.  McCoin lit the fuse on several sticks of dynamite below the floor of the trailer house.
 
The dynamite was detonated under the corner of the Whites' bed, turning it over and knocking both of them nearly out of harm's way from flying shrapnel and wooden debris from where the bomb was set under the floor of their trailer house. 
 
Once the dust cleared it was determined, Mitchell suffered several broken ribs; Jeanette suffered minor injuries. The child, McCoin's eldest son, suffered cuts and scrapes and broken glass embedded in his legs and feet caused by running barefoot to his mother's room to determine whether she was injured.
 
McCoin's life on the land quickly came to an end, now facing federal explosives charges.  Two days later McCoin was arrested and now faced felony possession of explosives charges.  After the bombing, psychiatrists appointed by former East Texas federal judge William Wayne Justice ruled McCoin incompetent to stand trial.  McCoin spent the last six years at a federal mental institute, and was judged competent to returned to Texas in 1999.
 
McCoin was re-indicted on state charges of attempted capitol murder on October 14, 1999.  During his trial in Red River County, McCoin attempted to represent himself at trial and at one point was removed from the courtroom during pretrial motions where he rushed 102nd District Court Judge John F. Miller Jr.'s bench in a confrontational manner.  Red River County Sheriff Chief Deputy Larry Spangler and Deputy Terry Reed briefly struggled with McCoin who was carried out of the courtroom by the deputies.
 
A Red River County Jury quickly found McCoin guilty during his trial and sentenced him to 99 years in the Texas Department of Criminal Justice.  McCoin would later attempt to appeal his case claiming to not have been competent to waive counsel.
 
McCoin while in federal custody had spent several years in a prison psychiatric facility at the U.S. Medical Center for Federal Prisoners (MCFP), in Springfield, Missouri until 1999.  McCoin's violent psychiatric episodes continued while incarcerated in the Texas Department of Criminal Justice.  January of 2014, McCoin was transferred by Texas prison officials to the Montford Prison Psychiatric facility which became his prison of final destination. 
 
McCoin's death after his confrontation at the 94 treatment bed facility will remain under investigation by the Texas authorities.  At this time it is believed McCoin's death is the result of heart failure, but an autopsy is pending in the final cause of death.  His madness may have been his final demise.

  4. Montford has ac I have told u before I am an exoffender now. Been out six yrs seen guards abuse inmates saw an inmate get killed his head slammed down on concrete the two officers a maj was transfred to another unit the other officer was given probation then at neal a inmate passed out in commissary line and a guard kicked him in his side said get up u sob next I had a cellie die he went to medical six times and when they did an in and out we found him dead I will be going to the tv stations after I get off of parole in a yr

    1. And I have seen numerous times where inmates pretended to pass out and then assaulted staff or were gaming to get off their building or whatever. Its an unfortunate by-product of the environment were 90% of the inmates are gaming, so staff start to think all of them are.

    5. I currently work for montford and id say it one of the most proffessional run prisons in TDCJ, if an inmate gets treated like hes a mental patient, its because by contract between us , him , and medical, he IS.

In this case, that violent POS caused himself to have a heart attack. When you spend your life hating, this is what it does to your heart. Stop hating. With over 153,000 inmates and 39,000 employees, things are going to happen, that does not stop the prison system from running.

The inmates play dominoes and hang out with other criminals. The entire system needs to be changed towards a rehabilitative approach towards inmates. But, that can't happen because there's no money in that!

      BTW, congratulations on having a wife, a great church, and a great job. Those are all things that an offender on parole needs. Those are all part of the support structure that you'll need if you intend to stay out of prison. But, to come here and tell US not to judge is a bit hypocritical don't you think? You were one of the FIRST to judge, based solely on the article. You have no first hand knowledge of anything regarding this case. Or, has that little fact slipped your mind. You might be able to post your drivel on some offender friendly website without challenge. But, NOT HERE. You WILL be challenged here. So, if you want to continue to post, get used to it.

    2. TDCJ's "evil deeds". TDCJ is an entity made up of policies and rules. Some staff follow them, some staff don't. Kind of like laws in the world eh? I'm glad you turned your life around, but the agency isn't "evil", though some of the staff are pretty bad. Its hard to weed them out, especially when the units are understaffed as it is.

    1. BTW, just out of curiosity, what units do you do prison ministry? Some folks think it does some good, some don't. I'm of the belief that it all depends on the intent of the individual. But, rehabilitation techniques are a whole other subject for a different day.

  9. When I was an offender in tdcj been down twice I admited my guilt owned up to it follwed all rules no cases no fights rode solo praticipated in itp programs even got my ged but guards at times are out of line that is why I am adamant about exposing evil deeds

As you well know, EVERY offender says officers are horrible and corrupt. What makes YOU any different than ANY OTHER offender who says the same thing??     1. What you waiting on?? If you got solid evidence of criminal activity bring it forward to the authorities having jurisdiction. Sitting on it won't help you, or the agency.

      While I ain't no hug a thug, I also can't stand a crooked boss. I think a crooked boss is WORSE than an inmate. Over the years I've done my share to get rid of several crooked bosses. And, I'd do it all over again. A crooked boss makes all the good ones look bad.

      So, my feeling is if ANYONE has evidence of criminal activity that's solid they should bring it forward to authorities. But that's just me.

      In your case, just guessing from what you wrote, you have some grievances that possibly weren't resolved to your satisfaction? Somehow that doesn't seem like much evidence. I used to work directly with grievance personnel, both at the unit level and at the regional level. So, to me, you saying you have some grievances doesn't really hold much water. If there was evidence of criminal wrong doing uncovered at the step one or step two level action would have already been taken. In your case, based on what you've written, it appears that action wasn't taken to your satisfaction. And, if that's the case, it was probably because there was no evidence to support action being taken.

      But, what do I know. I've been wrong before. lol

  13. Something most inmates, inmate family members, inmate friends, fail to think about is that officers must treat ALL OFFENDERS the SAME, PERIOD. We NEVER know which offender will try to hurt us, or bring in contraband, or hurt another offender. We cannot afford to differentiate between good, or bad, offenders. We must look at ALL OFFENDERS as a possible threat. Our very lives depend on it. The lives of our fellow employee's depend on our vigilance in this regard.

    So, when I, or any other officer says all offenders are POS's we know there are some who are trying to do well and get out without getting into trouble. We know there are offenders who would not hurt us. But, for our safety we cannot afford to treat those offenders any different than ones who may be violent. We MUST look at ALL OFFENDERS as a possible threat, and act accordingly.

    This is a concept that you, and many other offenders like you seem to not understand. While, our attitudes may seem harsh to you, those attitudes keep us alive. My attitude kept me alive for over 30yrs working Texas prisons. So, I don't intend to change that attitude. I only ask that you make an effort to understand where that attitude comes from, and why it's necessary.

    I don't normally make an effort to explain myself to ex-offenders. But, in your case it seems you may be making a genuine effort to understand. Hopefully, my explanation here will help you understand.

  14. This is the complaint I am writing right now (very timely indeed) in regards to my brother who is incarcerated at the Montford Unit:

    just received my first letter from my brother after filing the first complaint. He informed me that he is being transferred to another unit. I am writing to inform whomever of the retaliatory measures that were taken as a result. Even though he is gone from the unit, I would think that these people will continue to abuse others and they need to be stopped.


    1. Geoff's stitches were removed before the incision was completely healed. When he returned to his cell, it had been torn apart. Retaliation.

    2. Geoff was then called to LT. Potts' office who had the case written against him for "refusing to work without a legitimate reason". Geoff showed him the I-60 which stated the following:


    "Contacted medical. They state it was for 4 days and it's already expired. You're currently in medical as I write this. If they place a U/A med they should notify me today". C.U.C Thomas


    Per Geoff, Lt. Potts ignored the I-60 and went by the roster, which was incorrect (this was their discussion). Lt. Potts told Geoff that he cannot fight the system, found him guilty of the above offense and sentenced him to 15 days restriction. Retaliation.


    3. Per Lt. Potts and Sgt. Arguelles - Dorm janitors (this would be Geoff's job, of course) are to work the entire 8 hours, without a break. They cannot sit down or leave to use the restroom. Sgt. Arguelles stated she didn't care, that they could scrub the same brick for 8 hours. Retaliation.

    4. Inmate Bush was given a case for sitting down because his feet hurt (other inmates are now suffering). What is this called? Abuse of power?

    5. Geoff states that while he was in medical that he learned that Lt. Potts comes in there at least 3 times a week to pressure the doctors to remove inmates from restriction. WOW! TV show Madness except in reality!!!

    6. Another inmate had a mangled leg with pins and plates and was taken off restriction and forced to stand for 8 hours (must be a dorm janitor).

    7. Night janitors are still forced to work in the dark, also with no breaks and no sitting. Per Lt. Potts and Sgt. Arguelles. WHY ARE THESE SOCIOPATHS IN CHARGE?

    8. Saved the best for last - INMATE BENJAMIN MCCOIN WAS MURDERED BY GUARDS. Ben was 64 years old and frail. His cell was stormed by guards carrying shields and batons.


    INVESTIGATE THE ABUSE AT MONTFORD UNIT BEFORE MORE PEOPLE ARE ABUSED AND/OR MURDERED

      Here's my latest email to the ombudsman. The guards and the prison system are abusive whether you want to admit it or not. And FUCK YOU I WILL NOT SHUT UP

      1. Inmates can only shower M-W-F. This is due to a shakedown which began on August 11, but my brother states that on other units this limit would only last for the first 2 or 3 days.
      2. On Monday August 18, 2014 officers yelled for showers and that everyone must be clean shaven. After 5 minutes the doors were rolled shut and about 20 people weren't able to shave, therefore Sgt. Gibson denied them access to the shower. Seems pretty improbable to be able to shower AND shave in 5 minutes. They were not even given soap so that they could wash using the sink in their cells. AGAIN - ABUSE OF POWER!!! Good hygiene should be a basic human right, not a privilege


      3. On Wednesday August 20,2014 a similar situation happened only this time they were denied showers because they were not HAVING THEIR "STATE" SOCKS. They were not told that NO SOCKS = NO SHOWER when called to the showers. ABUSE OF POWER!!!
      4. Inmate Sullin in C2-107 has boils (staph infection) all over his body. He was denied a shower in one of the previous examples even after showing the guards his infections. Staph infections can lead to death and even guards can catch a staph infection from the inmates. It is highly contagious. Hospitals are sued for spreading staph infections to patients. This is so disgusting that I don't even know what to say!
      4. Geoff's cellmate Alfred Thomas in C2-203 wears diapers and was denied a shower in one of the examples given above. He is also frequently dirty in the same diaper for days at a time. He apparently is not capable of keeping himself clean. My brother has to live with the smell and the overall disgusting situation. This seems to be unusual and cruel punishment.
      5. The law library does not have law books. There is only 1 computer. He is blamed for not asking for a lay-in for the law library. THERE ARE NO LAW BOOKS. Geoff is being denied his right to appeal his conviction because he does not have adequate access to the law. THIS NEEDS TO IMMEDIATELY CHANGE

      6. It is summer and there is no air conditioning, or fans at this unit. THIS IS ABUSE

    1. Using chemical agents on offenders to gain compliance with lawful orders actually reduces the risk of injury, either to the offender or the staff attempting to gain compliance. NOT using chemical agents INCREASES the risk of physical injury. Chemical agents are a very useful tool in the UOF continuum.

  18. I know firsthand about why the use of teargas is needed at TDCJ. Try not using it on Offenders to have them comply. Ferguson Unit in the spring is when testosterone levels are @ an all time high. Combine that with the thug mentality and offenders not wanting to act civilized but instead wanting to exhibit characteristics of wild animals and one will see why teargas is needed to break up riots for cell extractions. Not just on Ferguson but on many if not all prison units. Offenders will cut theirselves for attention while asking Officers to watch the blood squirt. Offenders also place objects between solenoids inside door jams to rig the door to make one appear as closed. Offenders are not to be trusted. TDCJ needs to use teargas. If an offender suffers from such, it is their fault as they choose to not follow rules. Good riddance William McCoin. One less problem for TDCJ. GTR 637784.

I've read the manuscripes of the trial and it came out at Ben's trial that the ex-wife was injuried,his own son was injuried and the husband of his ex-wife was injuried. Plus Ben's 2 daughters were in the mobile home.

  31. I was going to complain about this being the single most biased story I have ever read. However, I then scrolled up and read the name of the website. Apparently, this website is nothing more then a blog for COs. I have never been to prison however I am a mental health professional (Masters degree in Clinical Psychology, LPC) and I am well aware through my patients that the criminal justice system is more than broken. This system is nothing more than legal slavery and the COs are the slave masters with the wipes. There has even been peer reviewed scientific studies giving empirical evidence of the potential for men to become controlling, ego maniacs when put in charge of other human beings (i.e., Standford experiment). One thing I know, I have never met a "criminal" that did not admit to their own short comings however I have met many a person in a position of power that will refuse to have any kind of self reflection. Instead these are often people that can only justify themselves and gain a sense of self importance through the degradation of others that they lord power over.
