Texas State Representative Jerry Madden looks into TDCJ mediation practices after seeing Backgate Story

State Corrections  Committee chair Jerry Madden has stated to the Backgate that he is looking into the current system of mediation as we know it within the agency. The Backgate story published yesterday regarding the broken system of TDCJ mediation that allows some TDCJ employees back to work after committing severe rule violations and even sometimes illegal acts is under review by the house Corrections Committee Chairman.

In an email to the Backgate from Representative Madden, he states that the current system is now under review by the committee. The Backgate recently received information under the Texas open records act that showed that some terminated employees were allowed back to work after the TDCJ internal mediation process found loopholes in the current system that allowed them back. Some of those employees where charged and found guilty of acts that were illegal, to include establishing intimate relations with offenders. Charges that are described in the Texas penal code as a state jail felony.

Is TDCJ overlooking such charges to maintain staffing levels ? If so, what examples for new incoming staff members does that provide ? Has the agency sold itself out to avoid legislative scrutiny over staffing issues ? Is this adding to an atmosphere of corruption that has plagued the agency for years ?   1. That is a good post of Jerry Madden. Nice of him to respond to thebackgate's aka badgate's concerns. Don't expect him to open that mediation can of worms. TDCJ has been using the weaknesses in the mediation system to serve a completely different agenda, designed to weed out employees that accurately report defalcations. Jerry Madden will not do something that will not benefit him personally. That is a nice picture of him though. How long ago was it shot? He weighed more and looked healthier. Did he have a bypass or something major recently?

  2. The whole TDCJ system is broken . But in fairness I will say that the mediation process has saved my butt on one occasion where retaliation was the contributing factor and false charges were brought against me , however even though I was re-instated that diciplinary action remains on my record. A second incident occured on another unit and of course retaliation again , if there is going to be a mediation there needs to be an in-dept investigation to all the facts that have brought about the charges in the first place , and that needs to be taken into consideration , and follow up charges need to be taken against the accusers for filing false charges on the employee weather it be another officer or a warden. The most important thing about disiplinary actions , dismissal and mediation is that it should not be used as a weapon against people who come forward to report corruption in the system . Unfortunately I have not yet come across one person be it politician or TDCJ administrator who truly cares to take action and help the wrongly accused . If there is one please let me know who they are ! Personally i'm tired of hearing about guys like Sen. Whitmere and Rep. Madden who only have there own agenda at hand .

  3. Tired of hearing their names??? Getting them to acknowledge it publicly is the first steps. Good job with that Backgate. Make them crawfish. Until its made public it will never change. This site does that well. Keep it up!

I to am tired of seeing the good ole boy's do what they want and then keep their job's, the real hard workers who are wrongly accused of course needs the mediation, I find that if you are not liked they will get rid of you one way or another and mediation does not help the truly innocent. I am glad someone will look into the mediation, I know of certain good ole boy's who get shuffled from unit to unit just to keep there rank.

  5. Certain good ole boys getting shuffled from unit to unit appears to be the custom, policy, and practice. Does it happen more in some Regions than others? Those certain good ole boys seem to do more than their share of the false accusations as a means of dodging true accusations against themselves. Their history is concealed when they come into the new unit. All the potential new victims know is that the officer came from another unit or resigned so they could immediately be rehired at the unit of their choice.

  6. i beleive in mediation but how on earth can it work when it is TDCJ doing the mediating, There will never be any fairness by doing this, i dont know why they dont get an outside, unbiased agency for this. Your right there are too many good ole boys out there in this agency.

  8. I'm trying to get back on with TDCJ and I keep on getting the runaround on me. I've been falsely accused by a Captain and nobody is willing to look into this. Huntsville keeps on saying that they'll look into it and I have yet to be notified. I was a hard working honest officer but I didn't fit into the Captains click. So the man decieded to make it personal to get rid of me because I've stood up for myself against his burn off lacky's. If anybody knows what to do please let me know.

  9. that's just the way it works in tdcj .
    I was accused of bringing in drugs, establishment of a relationship. I was assigned to 1 building for 6 months I still didn't quit. Then they said I wrote a letter to an inmate. An inmate tried to grab my butt and the Lt. Said it was because I played with them. Going in doing your job isn't exactly playing when you write cases and have your wings under control. I had been to the wardens office so many times. I quit my job even tho I needed my benefits.

  10. Well the mediation system, the employee grievance system and everything else TDCJ has in place is nothing but a joke and a way to show they tried before litigation starts. The thing with TDCJ is they think that no one will sue them. But i bet the first suit they get, and they will lose, will hit the papers and TV and people are going to question why we are broke laying off teachers but TDCJ is paying out millions in lawsuits over stupidity. I see it headed down that road.

I resigned my job with tdc because they said an inmate had my number which is false, and if he did i don't know how I'm guessin an inmate could over heard a conversation in which i gave ma number to another co. i was at the telford unit which is a real bad unit, i was havin more problems with the other officers than with the inmates, all my co workers would try to talk to me im a 22 year old female and a prison is not a positive environment for a young female.
